Kolkata: The West Bengal government is yet to decide whether it would approach the Supreme Court challenging the Calcutta High Court's order terming the March 14 police firing in Nandigram as wholly unconstitutional and said it was still consulting legal opinion.
"Legal consultation RPT consultation is yet to be completed. The state government will also discuss the matter with Advocate General Balai Roy", Home Secretary P R Roy told reporters when asked whether the state would challenge the high court order in the apex court. After the high court order on November 16, the Advocate General had said he would advise the state government to appeal against the verdict on the ground whether CBI could investigate criminal cases without the consent of the concerned government.
"I will advise the state government to go for an appeal on this point but it is upto the state government to decide," he had said. CPI-M patriarch Jyoti Basu had on Saturday said the state government should file an appeal in the Supreme Court challenging the high court order.
