Mumbai: The Bombay High Court today asked the Maharashtra government to decide within 15 days what action it was going to take in the Khwaja Yunus custodial death case, pursuant to completion of investigation.
Yunus, arrested after the December 2002 blast at suburban Ghatkopar, disappeared from custody in the first week of January, 2003.
Police said he disappeared while being taken to Aurangabad, while the co-accused in the case alleged he was tortured during interrogation which led to his death.
In September, a magisterial court at Parner had held that the complaint filed by the police that Yunus escaped after the jeep taking him to Aurangabad met with an accident near Parner was "false and malicious".
The CID, which probed Yunus disappearance, too has concluded that he died in custody.
Public prosecutor Satish Borulkar today told the court that CID investigation was complete. However, the government is yet to decide whether to prosecute the crime branch officials indicted by CID.
The court today, while accepting findings of Parner court, took police to task for "misleading" the court earlier.
