Chennai: The Madras High Court today initiated suo motu contempt proceedings against the Tamil Nadu Government and External Affairs Ministry for not implementing its earlier order over bringing the body of an Indian youth, allegedly killed in Malaysia.
A Division Bench, comprising Chief Justice A P Shah and Justice V Ramasubramanian, initiated contempt proceedings and posted the case to December 7, for the next hearing.
The Bench directed the Union of India, represented by Secretary of Ministry of External Affairs, to be impleaded as party to the contempt proceedings. The proceedings were also initiated against Tamil Nadu Chief Secretary and Home Secretary.
On August 28, 2007, the Madurai Bench of the Madras High Court directed the Chief Secretary and Home Secretary and the High Commissioner of India in Kuala Lumpur to help petitioner, Sethuraja, to bring the body of his son, Suseendran within three weeks. Sethuraja alleged that his son had been murdered by a gang in Malaysia.
Besides ordering bringing back Suseendran's body, the court also directed registration of the FIR and submission of a report of investigation within three months. Sethuraja said the court orders were not implemented even after three months.
The High Court today took suo motu notice of a newspaper report about a petition filed by Sethuraja of Kummakurichi near Paramakudi in Ramanathapuram district in the Madurai Bench of the High court seeking court's intervention to bring his son's body.
