FIR can be registered under any police station: HC

New Delhi: The Delhi High Court has held that if a crime is committed under the jurisdiction of various police stations, an FIR can be registered at any of them.

"If the crime is spread over various police stations, then FIR can be registered at any police station within which the crime has taken place. Crime can not be registered on the basis of residence of the complainant or the residence of the complainant's father or the effect of the crime," Justice S N Dhingra observed while asking the Bihar police to transfer a dowry harassment case to Delhi.

"The FIR can be registered even if a part of the crime has taken place within the jurisdiction of that police station," Dhingra said in a recent judgement. The court order came on two petitions filed by one Shweta's husband Niraj Trivedi, his brother Parimal and sister-in-law Anju seeking quashing of FIR lodged by the father of Shweta against alleged harassment of his daughter for dowry in Delhi and USA, on the ground that the case was registered in Bihar.

According to the FIR, Shweta, who hails from Bihar, got married to Niraj in 1998 at Delhi. After few days, both of them had shifted to USA as Niraj was working there but Shweta had complained that her in-laws had started harassing her for dowry in that country. She was also physically tortured by Niraj and his other close relatives for dowry, the FIR said.

In 2002, Niraj had filed a divorce case in a court in New Jersey against Shweta, which she is presently contesting, as per the complainant.
