Mumbai: A Maharashtra Navnirman Sena (MNS) activist today moved a sessions court here seeking bail after police detained him on February 7 as a preventive measure for maintaining law and order situation in the city following the clash between MNS and Samajwadi Party workers.
Additional Sessions Judge K P Joshi, however, held that bail was not the correct remedy. As such, the detained person Arvind Gavde should file a criminal representation before the sessions court.
Gavde had been detained by the MRA Marg Police Station in South Mumbai on February seven after MNS and Samajwadi Party workers clashed on February three leading to tension in certain areas.
As a preventive measure, 13 persons including members from both parties were detained by the MRA marg police and they were remanded to Judicial Custody for ten days by a local court.
Gavde's application today stated that he had been maintaining a low profile as an activist and had not been part of any such activity for police to apprehend a law and order problem involving him.
Prosecution, however, pointed out to the court that bail was not the correct remedy in this case, which was accepted. Gavde's lawyer withdrew the bail application and filed a criminal representation application, which will be heard tomorrow.
