JJ shootout: Discharge of accused to be challenged

Mumbai: The prosecution will soon file its appeal before the Supreme Court challenging the discharge of inter-state gangster Brijesh Singh from the 1992 J J hospital shootout case by the special TADA court.
Special public prosecutor Rohini Salian has written a letter to the principal secretary of the law and judiciary department of the state recommending to file an appeal in the case challenging Singhs discharge.
Singh, who is booked in several cases of murder, attempt to murder and extortion, was discharged by special TADA Judge D U Mulla on September 22 in the 1992 J J hospital shootout case.
Singh was discharged after the court observed that there was no evidence against him. The court had remarked that other than the confessional statement of co-accused, there was no evidence against Singh.
The letter to the principal secretary states that under the provisions of TADA, the Supreme Court had recently held that the confession of other accused can be used as subtantial evidence against each other.
The incident dates back to September 12,1992,when about 24 persons including Singh barged into the state-run JJ Hospital and opened fire on Shailesh Haldankar, a member of the Arun Gawli gang who was admitted in the hospital for treatment.
Two police constables guarding Haldankar were also killed in the shooting. Haldankar was killed to avenge the murder of Dawoods brother-in-law, Ismail Parkar.
