New Delhi: In a traffic rule violation case, the Delhi High Court has slapped a fine of Rs 5,500 on a lawyer for not discharging his duties and furnishing wrong details in court about the offence.
Based on the details given by lawyer V K Pandey, Vijay Kumar Saroj instead of real offender Vinod Kumar was issued warrant by a city court for a traffic rule violation.
Rejecting the submission made by Pandey that he filed the bail bond in the name of Saroj, after the details were provided to him by Tarakant Jha, the owner of the disputed vehicle driven by Vinod, Justice Kailash Gambhir directed the lawyer to pay the amount within a week time.
"The counsel should have been careful enough to at least see the particulars in the traffic challan before filing the bail bond. Pandey failed in discharging his duties as counsel and has wrongly filled the particulars of Saroj, who had nothing to do with the traffic violation," said Justice Gambhir in a recent order and discharged Saroj.
In a petition, Saroj said he had never committed a traffic violation and no challan was issued against him. The court has wrongly issued warrant against him, he said, adding that due to the warrant, he had undergone a lot of harassment.
According to the case, challan was issued against Vinod, who was driving Tarakant Jha s vehicle, for traffic violation near Khanpur in South Delhi.
Tarakant had engaged V K Pandey as the counsel to defend Vinod and he himself stood as surety for Vinod at the time of his release on bail.
Instead of Vinod, the counsel filled the bail bond in the name of Saroj as a result Saroj had to face the court warrant for appearance in the traffic violation case.
