NEW DELHI: Despite the UNSC proscribing Jamaat-ud-Dawaa (JuD), a front for the Lashkar-e-Taiba, Pakistan has so far merely given an illusion of compliance with the restrictions that have to be slapped on the organisation.
India is carefully watching whether the JuD is donning another guise. New Delhi suspects that the Tehrik-e-Hurma-e-Rasool, loosely translated as a movement for defending the honour of the Prophet, may soon become the JuDs new garb. JuD chief Hafiz Saeed continues to direct the campaign to defend the Prophets honour, in violation of the UN ban.
India is mulling over what can be done to force Pakistan to comply with the UNSC resolution under chapter 7 of the UN charter, which makes action against JuD obligatory. Otherwise, the UNSC can go for punitive action against Pakistan. This could take several forms, including a tough sanction regime.
If Islamabad refuses to enforce the ban, it will be failing in its obligation to counter terrorism, which as a responsible member of the UN it is bound to follow. New Delhi may then approach the UNSC. Among the five permanent members of the Security Council, China may be the only country reluctant to support India. Other members like the US would also refrain from taking an extreme step considering it is dependent on Pakistan for the war on terror.
Now that the JuD has been banned, other provisions of the UNSCR 1267 should also be applied by Pakistan. In other words, the JuD should be prosecuted by Pakistan for its activities. Yet none of this has happened.
Jud chief Hafiz Saeeds movements have been restricted but he has neither been prosecuted nor any charge levelled against him. He has been kept confined to his home and not allowed to address rallies or gatherings. But there is no restriction on people meeting him at his residence. Source : Central
