The Section 377 of the IPC as far as it criminalises gay sex among consenting adults is violation of fundamental rights, says the High Court.

Section 377 will continue for non-consensual, non-vaginal sex, the court said.

Any kind of discrimination is anti-thesis of right to equality, says the court, while allowing plea of gay rights activists for decriminalisation of homosexuality.
